ERRANDLY — TERMS OF SERVICE

Welcome to Errandly ("we," "us," "our"). These Terms of Service ("Terms") govern your use of Errandly's platform, including its website, mobile application, communication channels (such as WhatsApp Business API), and any services provided (collectively, the "Service").

By accessing or using Errandly, you ("User," "Customer," "Runner," or "You") agree to be bound by these Terms. If you do not agree, you must discontinue use of the Service immediately.

1. DESCRIPTION OF SERVICE

Errandly is a platform that connects individuals who need errands completed ("Customers") with individuals willing to perform them ("Runners").

Access to the Service may be provided via a mobile application, website, or third-party communication tools (e.g., WhatsApp). All interactions conducted on these third-party tools for Errandly services are subject to these Terms.

Important: Errandly acts as a neutral technological intermediary, not a courier company, employer, agent, or logistics firm. We facilitate the connection and payment but do not take possession of goods.

2. ELIGIBILITY

To use Errandly, you must:

  • Be at least 18 years old.
  • Have full legal capacity to enter into a binding contract.
  • Provide accurate registration information.
  • Not be suspended or banned from Errandly.

3. USER ACCOUNTS

3.1 Registration

You may need to create an account or join an Errandly communication channel. You must provide accurate and complete information.

3.2 Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3.3 Verification

To ensure trust and safety, Errandly requires identity verification.

  • Runners: Must provide a valid Government ID (NIN, PVC, Driver’s License, or International Passport) and details of a verifiable Guarantor.

Errandly reserves the right to background check Runners against criminal databases where available. Accounts that fail verification will be disabled.

4. NATURE OF RELATIONSHIP

4.1 Independent Contractors

Runners are independent, self-employed individuals. They are not employees, agents, representatives, or partners of Errandly.

4.2 No Employment Relationship

Errandly is not responsible for payroll, taxes, pension, insurance, or any other employment-related obligations for Runners.

4.3 No Agency

Errandly does not act as a representative of Customers or Runners.

5. USER RESPONSIBILITIES

5.1 Customers Must:

  • Provide accurate errand instructions and item details.
  • Ensure items are lawful, safe, and properly packaged.
  • Pay agreed fees promptly via approved channels.
  • Be available for communication until the task is complete.
  • Respect the Runner’s time, safety, and boundaries.

5.2 Runners Must:

  • Complete tasks safely, responsibly, and within agreed timelines.
  • Packaging Verification: Verify the condition of external packaging before accepting an item. Runners are not required to open sealed packages but must reserve the right to refuse items that appear suspicious or violate Section 5.3.
  • Comply with all applicable laws (e.g., traffic laws).
  • Handle Customer items with care.
  • Maintain professionalism and courtesy.

5.3 Prohibited Items

Users strictly agree NOT to request the transport or purchase of:

  • Illicit drugs, narcotics, or controlled substances.
  • Firearms, weapons, ammunition, or explosives.
  • Stolen goods.
  • Cash in excess of ₦50,000 (unless using a specific 'Cash Errand' service with verified insurance).
  • Live animals (without prior approval).
  • Human remains or bodily fluids.
  • Any item prohibited by Nigerian law.

6. ACCEPTABLE USE & CONDUCT

Users must comply with Errandly’s Acceptable Use Policy (AUP). Prohibited activities include:

  • Fraud, deception, or misrepresentation.
  • Harassment, threats, or abusive conduct.
  • Spam or unauthorized advertisements.
  • Attempting to exploit or bypass platform rules.

Violation of the AUP may result in immediate suspension, termination, or legal action.

7. PAYMENTS

7.1 Fees & Escrow

Fees for errands are agreed upon between Customers and Runners or determined by Errandly’s pricing model. To ensure safety, Errandly may hold Customer payments in Escrow until the Runner confirms completion of the task and the Customer validates receipt (or a reasonable time window elapses).

7.2 Payment Channels

Errandly facilitates payments through approved payment processors or direct settlement channels.

7.3 No Payment Circumvention

Users must not bypass Errandly to settle tasks off-platform (e.g., exchanging cash or personal bank transfers to avoid fees).

  • Penalty: Users caught arranging off-platform deals for tasks initiated on Errandly will be permanently banned and may forfeit any funds currently held in their Errandly wallet.

7.4 Refunds

Errandly is not obligated to provide refunds. Dispute resolution will be handled on a case-by-case basis.

8. SAFETY & LIABILITY

8.1 User Responsibility

Customers and Runners assume all risks associated with errands they request or accept.

8.2 Limitation of Liability (The "Cap")

Errandly does not physically handle packages or directly supervise tasks. Therefore:

  • Limited Liability: Except where Errandly has explicitly offered an insurance add-on, Errandly’s total liability for any claim arising from the use of the Service is limited to the total service fee paid to Errandly for that specific errand, not the value of the goods transported.
  • Errandly is not liable for loss, theft, damage, delays, or injury occurring during tasks.

8.3 Theft & Police Cooperation

While Errandly is not liable for theft committed by a Runner, we take such matters seriously. In the event of theft, Errandly will cooperate fully with law enforcement agencies and provide all available details of the Runner (including ID and Guarantor information) to the Customer and Police.

9. DISPUTES BETWEEN USERS

Errandly is not responsible for resolving disputes between Customers and Runners but may, at its discretion:

  • Review communication logs.
  • Temporarily freeze accounts.
  • Mediate disputes informally.
  • Provide recommendations.

Errandly does not guarantee conflict resolution outcomes.

10. COMMUNICATION & PRIVACY

10.1 Third-Party Platforms

Users acknowledge that Errandly may utilize third-party messaging platforms (e.g., WhatsApp). Errandly is not responsible for data breaches, service outages, or policy changes caused by these third-party providers.

10.2 Data Use

Use of Errandly is governed by our Privacy Policy. Users consent to the reasonable collection and processing of their information for the purpose of service delivery.

10.3 Recording

Users shall not record private conversations without consent.

11. TERMINATION

Errandly may suspend or terminate accounts for:

  • Violating the Terms or AUP.
  • Fraudulent or unsafe behavior.
  • Refusal to cooperate with verification.
  • Repeated complaints from other Users.
  • Any action deemed harmful to Errandly’s community.

12. WARRANTY DISCLAIMER

The Service is provided "AS IS" without warranties of any kind. Errandly disclaims liability for indirect, incidental, or consequential damages arising from the use of the Service.

13. INDEMNIFICATION

Users agree to indemnify and hold Errandly harmless against claims, liabilities, damages, or expenses arising from:

  • Errand misuse (including transport of prohibited items).
  • User negligence or misconduct.
  • Violations of these Terms.

14. MODIFICATION OF TERMS

Errandly may update these Terms at any time. Significant changes will be communicated via official channels. Continued use of the platform indicates acceptance of modified Terms.

15. GOVERNING LAW

These Terms shall be governed by and interpreted according to the laws of the Federal Republic of Nigeria, without regard to conflict-of-law principles. Disputes shall be subject to the jurisdiction of courts in Nigeria.
